What types of child custody are recognized in Nebraska?

A person who is going through child custody matters in Nebraska will hear quite a few terms about the types of custody that are possible. In all cases, it is vital that all parties in the child custody case understand what each of these terms mean. Let's take a look at the four types of child custody that are recognized in Nebraska so that you can have a solid base of understanding when you hear these terms.

What is sole custody?

Sole custody occurs when only one parent has the right to see and raise the child. The other parent generally doesn't have any rights to make choices for the child. The non-custodial parent does usually have the right to visitation and parenting time with the child.

What is split custody?

Split custody is one type of custody that isn't usually favored by the courts in our state. In this case, children are divided between the parents. That means that some children live with one parent and other children live with the other parent. There are concerns about the mental and emotional issues that might manifest with the children in this case.

What is joint legal custody?

Joint legal custody means that one parent has the children most of the time, but both parents share the decision-making responsibilities of the child. In this case, the parents will have to assure the court that they can work together to make educational, religious and medical decisions to benefit the child.

What is joint physical custody?

Joint physical custody means that the parents share the right to have the child live with them. The actual schedule depends on the circumstances of the parents. In some cases, the child might spend an equal number of weeks at each house or the child might spend the school year at one home and the holidays and summer at the other.
